1) Agreement to Terms

By purchasing from Bozo Phantum through our website (bozophantum.com) or at in-person events, you agree to these Terms & Conditions.

2) Products

We offer prints, stickers, accessories, apparel, digital downloads, and commissions (when available).

Product appearance: Colors may vary slightly due to screen settings, lighting, and printing differences. Minor variations may occur due to the artist-made nature of items.

3) Pricing, Taxes, and Payment

• Prices are listed in USD unless stated otherwise.

• Taxes (if applicable) and shipping are shown at checkout or on your receipt.

• Payment is due at checkout (online) or at time of purchase (in-person), unless otherwise agreed in writing.

4) Processing Time

Processing times vary by item and will be shown at checkout or communicated at purchase. Made-to-order items and commissions have estimated timelines that can change based on workload and response time for approvals.

5) Shipping (US + International) — Tracked Shipping Required

We ship within the US and internationally. Tracked shipping is required for all shipped orders.

Address accuracy

• You are responsible for providing a correct, complete shipping address.

• If an order is returned due to an incorrect/incomplete address, you are responsible for reshipping costs.

Delivery timelines

Carrier and customs delays are outside our control; delivery dates are not guaranteed.

International orders

Buyers are responsible for any customs fees, duties, VAT, or import taxes charged by the destination country unless explicitly stated otherwise.

Lost/damaged packages

• If your order arrives damaged, email bozophantum@gmail.com within 48 hours of delivery with photos of the item, packaging, and shipping label.

• If tracking shows “delivered” but the package is missing, please check with household members/neighbors and contact the carrier. We can assist with claims where possible, but outcomes are determined by the carrier.

6) Digital Downloads (Final Sale)

• All digital download sales are final once delivered/downloaded, except where required by law.

• Digital files are for personal use only unless a commercial license is purchased (if offered).

• You may not redistribute, resell, share, upload, or claim the files as your own.

7) Returns & Refunds (Non-Custom Website Orders) — 14 Days

We accept returns for non-custom physical items ordered online within 14 days of delivery.

Eligibility

• Items must be returned unused/unworn and in original condition (and packaging when applicable).

• Email bozophantum@gmail.com within 14 days of delivery to start a return.

Return shipping

• Buyer pays return shipping unless the item arrived defective/damaged or we shipped the wrong item.

• Original shipping costs are non-refundable unless required by law.

Refunds

Refunds are issued after the return is received and inspected and are sent to the original payment method.

Not eligible for return/refund

• Commissions/custom items

• Digital downloads

• Items damaged due to misuse, wear, or improper care

8) In-Person (Art Market) Sales

In-person purchases are final sale, except if:

• the item is defective/damaged/incorrect, or

• you are dissatisfied with the quality.

If there’s an issue, contact bozophantum@gmail.com within 48 hours of purchase with photos and proof of purchase when possible. Resolution may include a replacement, repair, store credit, or refund, depending on the situation and where permitted by law.

9) Commissions (Custom Work)

Deposit & payment

• A 30% deposit is required to reserve your commission slot and begin work.

• The deposit is non-refundable once work has started.

• Remaining balance is due before shipping (physical) or before final file delivery (digital), unless otherwise agreed in writing.

Revisions

• Commissions include 1–2 revision rounds, depending on the commission type/complexity. The revision allowance will be confirmed in writing before work begins.

• Revisions are typically limited to the sketch/concept phase. Additional revisions or major changes after approval may incur extra fees.

Timelines

Timelines are estimates and can change based on complexity and response time for approvals.

10) Copyright & Intellectual Property

Unless explicitly agreed in writing:

• Emmit retains all copyrights and intellectual property rights to all artwork, designs, and digital files.

• Purchasing an item does not transfer copyright.

You may not reproduce, distribute, sell, or use our artwork/designs commercially (including merchandise, branding/logos, ads, NFTs, or AI training datasets) without written permission and a separate licensing agreement.

Social sharing: You may share photos of your purchase; credit/tagging @[your handle] is appreciated.

11) Privacy

We collect only the information needed to fulfill orders (name, email, shipping address, and purchase details). We do not sell personal information. Payment processing may be handled by third-party providers used on bozophantum.com, subject to their policies.

12) Limitation of Liability

To the fullest extent permitted by law, Bozo Phantum is not liable for indirect, incidental, special, or consequential damages related to purchases or product use.

13) Governing Law

These Terms are governed by the laws of the State of Alabama, United States.

14) Changes to These Terms

We may update these Terms from time to time. The version in effect at the time of purchase applies to that order.
